The Will of James H. McHatton

I, J. H. McHatton, Sr., of Henderson County, Kentucky, being of sound mind and memory, but knowing the uncertainty of life, do now make and declare this to be my last will and testament, hereby revoking any and all will or wills by me heretofore made.


ITEM ONE: I desire all my just debts and funeral expenses to be first paid.

ITEM TWO: I bequeath the sum of One Hundred Dollars ($100.00) to the Bethel Baptist Church of Hebbardsville, Kentucky.

ITEM THREE: I bequeath the sum of One Hundred ($100.00) to the Masonic Home, Louisville, Ky.

ITEM FOUR: I bequeath to my niece Ellen Reid and my nephew, James McHatton, Jr., whatever remainder oil and mineral rights I own underlying my farm the surface rights and part of oil and mineral rights recently sold to Richard and Maggie Gilmore.

ITEM FIVE: I bequeath to my sister-in-law Mrs. Susie Nelson, any or all residue remaining in her father's (Cornelius Whitehouse) estate in which I may be interested.

ITEM SIX: I bequeath the remainder of my estate of whatsoever it may consist, being real, personal, or otherwise, in equal shares each, to my broter Will McHatton, to my half brothers George Sheffer and Lennie Sheffer, to my sisters-in-law Mrs. Maude McHatton and Mrs. Susie Nelson, and to my niece Ellen Reid and my nephew James McHatton, Jr.

ITEM SEVEN: I nominate and request the appointment of the Ohio Valley Trust Company, of Henderson, Kentucky, the executor of this my will.

Subscribed and acknowledged by the said J. H. McHatton Sir., as and for his last will in Qur presence, and by us signed as witness in his presence and in the presence of each other, this the 16 day of June, 1945.

I, J. H. McHatton, Sr., by this writing declare this to be the first codicil to my will dated June 16, 1945. I hereby revoke all provisions and bequest under item five as I have heretofore sold all of my interest in the Cornelius Whitehouse estate to my sister-in-law, Mrs. Susie Nelson.

I hereby revoke my bequest under item six so far as it concerns my sister-in-law, Mrs. Susie Nelson, and in lieu thereof I beaqueath her, Mrs. Susie Nelson, the sum of Fifty ($50.00) Dollars.

I, J. H. McHatton, Sr., by this Writing declare to the above codicill to my will dated June 16 1945 I hereby revoke all provisions and bequest and request under item five and also revoke any request under item six so far as it concerns my sister-in-law and my codicil and will, I do hereby bequeath that my sister-in-law Mrs.. Susie Nelson, shall share equally with all my other heirs.
