PRE-MARITAL AGREEMENT

BETWEEN

SARAH MCCLENDON and JOSEPH WENDELL

Henderson County April 4th 1809 (Book B Page 154)

Memorandum of marriage articles agreed upon by and between Joseph WINDELL of the one part and Sarah MCCLENDON his intended wife of the other part.

Witnesseth that as it is intended by both these Subscribing parties to Enter into a marriage contract it is mutually agreed and that by both parties that the said Sarah MCCLENDON shall as she has under Taken to be the Administrator of Benjamin MCCLENDON and guardian for the children that she the said Sarah shall act without any control from the said Joseph in all things relating to that business and that the said Joseph Windell shall not concern himself with any of the property so belonging to the Estate of said Benjamin MCCLENDON and it is further agreed that the marriage shall not make the said Joseph in any wise bound for the debts or contracts of said MCCLENDON neithershall he the said Joseph be accounted as EitherAdministration or Guardian as to have any thing to do in the Business of the said Estate. Neither is he the said Joseph to have any control of said negroes or land so belonging to the said Sarah to her free liberty to act and transact the said Business at her discretion and liberty in Testimony of which we have hereunto set our hand and affixed our seals this twentieth day of April 1808.

This Marriage agreement was presented to me in my office, proved by the oath of William BLACK, a witness thereto to be the act and deed of the parties therein named and thereupon admitted to record. Test. Ambrose BARBOUR clerk
